Note: these comments are preliminary in nature and subject to change upon receipt of more detailed information. These comments are for guidance and are not a substitute for all applicable Town of Oro Valley, Pima County, State of Arizona and Federal codes, regulations, ordinances and/or laws. 1. DRAINAGE A professional civil engineer registered in the state of Arizona will be required to prepare a hydraulic and hydrologic drainage report that conforms to the Town's Drainage Criteria Manual. Proximity to Highlands Wash requires that a floodplain analysis be included as part of the drainage report. This analysis requires floodplain delineation, water surface elevations and encroachment analysis for the 100-year flow event as determined in the hydrology section of the drainage report. An erosion hazard setback line shall be determined using the 100-year event flow and physical stream channel characteristics. Detention requirements shall be determined from the hydrologic comparison of existing and developed conditions. A scoping meeting can be arranged with The Town of Oro Valley prior to preparing the drainage report if the engineer desires. 2. SOILS A geotechnical soils report shall be prepared containing all geotechnical engineering information and recommendations applicable to this project. The minimum geotechnical information to be included in the report is as follows: 1. Soil stability of all proposed cut and fill slopes 2. Angle of shear and maximum recommended slope ratio of all proposed cuts or fill 3. Erosion vulnerability of all graded areas and created slopes 4. Stormwater siltation potential of soils for all graded areas and created slopes 5. Description of soil constraints on the structural design of all foundations footings and walls 6. Recommended compaction treatment of all fills areas 7. Identification of any potentially hazardous geotechnical areas where construction is proposed 8. Recommended treatment for stability, erosion and siltation control of all newly graded areas and created slopes 9. Determination of a pavement design section for roadways 10. Foundation design recommendations Soil classification and design bearing capacity shall be shown on the grading plan for all areas where structures are proposed. 3. TRAFFIC A traffic impact report is not required for this development Provide a left turn lane onto Naranja Drive. 4. LANDSCAPING Please ensure that sight visibility triangles appear on landscape plans. Section 4.8 of the Town of Oro Valley Subdivision Street Standards explains limitations to improvements within the triangles. Please ensure that there is coordination between the landscape architect and the engineer preparing the drainage and grading plans. 5. GRADING Grading shall be in conformance with the Town of Oro Valley Grading Ordinance, OVZCR Chapter 15. 6. GENERAL INFORMATION Restoration Assurances approved by the Planning and Zoning Department will be required prior to the issuance of a grading permit, see Section 4-901 of the OVZCR. The Preliminary Plat shall be prepared per Article 4-3 of the OVZCR. General Comments: • Type II grading permit is required for the mass graded site. • All utilities shall be located outside of pavement except sanitary sewer. • When designing lot pads keep in mind the limits of cut and fill specified in the grading ordinance(OVZCR 15-401). • Provide a lot layout that conforms to Section 15-405 of the Grading Ordinance. • A culvert shall be built at the wash that crosses Naranja Drive approximately 1000 feet west of First Avenue. Williams Circle, Suite 6000 West Tucson, AZ 85711 RE: OV 12-05-10, Pre-Application Conference, Melcor PAD between Lambert Lane and Naranja Drive, Parcel 224-28-1560 Dear Peggy: As a follow-up to the Pre-Application Conference on Friday April 8, the following are staff and agency comments: 1. The property development standards are those of CR-5 Pima County per the Melcor PAD. The Melcor Pad was adopted by the Town Council in 1994 which included an agreement to use the Pima County Zoning code in force at the time. The CR-5 development standards are found at Chapter18.29. Section 18.29.050 provides for small lot subdivision option which may be used within those areas zoned CR-5 by the PAD. 2. Due to the terrain of the project site, the Pima County Hillside Development Overlay Zone may be applicable. Chapter 18.61 of the Pima County Code outlines the development standards of the Hillside Overlay Zone. 3. Because of the isolated nature of the subdivision a Recreation Area should be provided within the project. 4. A Native Plant Preservation Plan per the Pima County Code shall be prepared and filed with the Preliminary Plat for the Project. 5. The Landscape Plans for the project should be filed with the Preliminary Plat. The Landscape Plan will be to the Pima County Code, but staff strongly urges the applicant to use the Oro Valley Plant list for the landscaping. If the landscape plan does not accompany the Preliminary Plat it will have to be approved by the Development Review Board prior to Town Council review of the Final Plat. www.townoforovalley.com 6. Architectural review will be required prior to the issuance of any building permits for the project. The model plans may be submitted for review by the Development Review Board after the Preliminary Plat has been approved. 7. A trail is to be shown on the plat and dedicated by the plat to the Town. The trail will follow the existing sewer easement through the site. The alignment of the trail shall connect with the trail alignment established by Rivers Edge II southeast of the project site. 8. You are planning more than thirty(30) residential units which will require two means of access or all residential units will need to have residential fire sprinklers. A connection to Naranja Drive from the project will not be permitted. 9. There will be no grading into slopes of 25% or greater, unless permitted by the Pima County Hillside Development Overlay Zone. The slopes backing to Pusch Ridge Vistas to the east have been stabilized and should not be disturbed, as the ridge already has residential construction completed on them. 10. It is staffs understanding that the Army Corps 404 permit has lapsed. A new 404 permit needs to be applied for prior to the plat being reviewed by the Development Review Board and Town Council. If, however, the approval of the 404 necessitates a redesign of the plat it will have to again be reviewed by the Development Review Board and Town Council. The 404 permit will have to be approved and issued prior to Town Council review of the Final Plat. 11. A riparian mitigation will need to be developed for any wash crossings and/or any disturbance within the delineated riparian area. Most of Highlands Wash has been delineated as a mapped riparian area. 12. A true flood plain delineation shall be completed prior to the filing of the Preliminary Plat. 13. Staff conveyed to you copies of the Drainage Agreement between Melcor and the Highland Mobile Home Park. Neither the Town nor the County are parties to said agreements. Prior to the filing of and/or review of any Preliminary Plat a neighborhood meeting with the Highlands Mobile Home Park shall be held with Town staff in attendance. It would be suggested that the neighborhood meeting be held early in the process. 14. Engineering Comments are attached. 15. Extension of the water main will be required. Rivers Edge II will construct a water main from Lambert Lane to the northern terminus of its property. America Built will need to continue that water main and may need to loop it. For further information and standards for construction please contact the OV Water Utility at (520) 229-5000. 16. The site is very challenging to develop, it would be urged that once a clear design has been decided upon and you have completed at least fifty(50%)percent of the engineering, the Town of Oro Valley staff and you review the design prior to any formal submittal. Please see attachments to review comments by other agencies. If you have any questions please feel free to contact me at (520) 229-4822 or bconant@orovalley.net. Very truly y urs, Robe M. RECITALS A. The Highlands is a mobile home subdivision located in Pima County, Arizona, lying north of Lambert Lane approximately one-half mile west of the intersection of Lambert Lane and North First Avenue (the "Highlands") . B. The Highlands was originally platted by the Lusk Corporation in 1960 as "The Highlands, Blocks 1 through 7 and Lots 1 through 357, " and recorded in the office of the Pima County Recorder in Book 15 of Maps and Plats at page 21. In addition to blocks, lots and streets, the 1960 plat of The Highlands also depicts as a "drainageway" an area located on the north side of Appalachian Street, a 60-foot drainageway between Appalachian Street and Matterhorn Street, and a continuation of the 60-foot drainageway from the south side of Matterhorn to the south boundary of the Highlands (collectively, the "Drainageway") . Portions of the plat depicting the Drainageway are attached hereto as Exhibit "A" . C. In 1973 Kewin Enterprises, Inc. resubdivided certain portions of the lots in the Highlands as "The Highlands No. 2, Lots 401 through 458. " The resubdivision plat was recorded on November 28, 1973 in the office of the Pima County Recorder in Book 25 of Maps and Plats at page 79. This resubdivision did not affect the configuration of the Drainageway; however, the Drainageway was described on this plat as "private" . A portion of the resubdivision plat of The Highlands No. 2 showing the Drainageway is attached hereto as Exhibit "B" . D. On March 14, 1986, by Warranty Deed, dated March 14, 1986, recorded in Docket 7741, page 867, in the office of the Pima County Recorder, Kewin Enterprises, Inc. conveyed to Highlands Associates title to Block 1 and Lots 346 through 357 of the Highlands, "together with all streets and walkways within The Highlands. " The properties conveyed to Highlands Associates pursuant to this deed comprise the common areas and facilities of the Highlands. Highlands Associates represents that it also holds title to the Drainageway. E. Melcor owns a parcel of land of approximately 280 acres, legally described on Exhibit "C" attached hereto, which land abuts the Highlands' north and east boundaries. Melcor prepared plans for a mixed use, planned community on this land which, when fully developed, would have included a maximum of from 1400 to 1700 residential dwelling units ("Villa del Oro") . A copy of the concept plan for Villa del Oro is attached hereto as Exhibit "D". F. A natural watercourse, the Highlands Wash, crosses the western portion of Villa del Oro from north to south. The 2 Highlands Wash drains a watershed of approximately 2, 120 acres. Upon exiting Villa del Oro on its south boundary, the Highlands Wash crosses the Highlands through the Drainageway. G. In 1985, Melcor sought rezoning of Villa del Oro from SR to CR-4 , CR-5, TR, CB-1 and CB-2, in Pima County rezoning case Co9-85-72. The arrangement of the requested zoning districts is depicted on Exhibit "E" attached hereto. In its review of the proposed rezoning, the Pima County Department of Transportation and Flood Control District ("PCDOT") noted that the existing Drainageway located within the boundary of the Highlands is inadequate to convey the stormwaters of the Highlands Wash in a 100-year event. The existing culvert structure for Matterhorn Street further constricts the capacity of the Drainageway. PCDOT has conditioned its support of the Villa del Oro rezoning on the provision of adequate conveyance for the stormwaters of Highlands Wash through the Drainageway, based on design solutions proposed by Melcor. H. On August 19, 1986,- the Pima County Board of Supervisors rejected Melcor's rezoning application for Villa del Oro as originally submitted. However, the Board has entertained a substantially reduced application for rezoning, which would result in approximately 1400 residential dwelling units. A copy of the revised concept plan for Villa del Oro is attached as Exhibit "F" . 3 I. In order to obtain rezoning for the Villa del Oro development, Melcor is willing to construct certain drainage improvements in the Drainageway intended to ameliorate existing substandard conditions. J. Highlands Associates desires to obtain the benefit of the proposed drainage improvements to the Drainageway, and is willing to convey to Melcor such easements and/or rights-of-entry as may be necessary to accomplish the improvements. AGREEMENT Now, therefore, in consideration of the promises and mutual covenants contained herein, the receipt and sufficiency of which is hereby acknowledged, Melcor and Highlands Associates agree as follows: ARTICLE I. INCORPORATION OF RECITALS Sec. 1. 01 The foregoing recitals are hereby affirmed by Melcor and Highlands Associates as true and correct and are incorporated herein by this reference. ARTICLE II. CONDITIONS PRECEDENT TO MELCOR'S PERFORMANCE Sec. 2.01 Melcor's obligation to perform under this Agreement is expressly conditioned upon the occurrence of each and all of the following events or actions: (a) The support by Highlands Associates for Melcor's rezoning application in case Co9-85-72 now pending before the Pima County Board of Supervisors, and 4 . any subsequent modifications to such rezoning sought by Melcor, its successors and assigns, provided such modifications do not deviate substantially from the revised concept plan attached hereto as Exhibit "F", such support to be evidenced by written or oral communications to appropriate Pima County officials by representatives of Highlands Associates; (b) The approval and adoption by the Pima County Board of Supervisors of an ordinance rezoning Villa del Oro pursuant to the application filed in Pima County rezoning case Co9-85-72 and substantially in accordance with the revised concept plan for Villa del Oro, attached hereto as Exhibit "F"; (c) The production by Highlands Associates of documentation satisfactory to Melcor and its counsel indicating that Highlands Associates has unencumbered fee simple title to the Drainageway; (d) The granting by Highlands Associates to Melcor and its successors and assigns of a perpetual flood control, construction, operation and maintenance easement in the northerly 100 feet of the Drainageway as shown on the concept plan for Villa del Oro, attached hereto as Exhibit "F", for purposes of constructing, operating and 5 maintaining portions of the Detention/Retention Basin (as that term is hereinafter defined) ; (e) The granting or causing to be granted by Highlands Associates to Melcor and its successors and assigns, of a temporary easement for the construction of a multi-cell box culvert on Matterhorn Street and for a temporary crossing at Appalachian Street and the Drainageway; and (f) The review and approval by Highlands Associates of landscaping designs prepared by Melcor for the Detention/Retention Basin, which approval shall not be unreasonably withheld. ARTICLE III. PERFORMANCE BY MELCOR Section 3.01 Melcor, at its sole expense, shall: (a) Construct a Detention/Retention basin to Pima County standards, located as shown on the revised concept plan for Villa del Oro attached hereto as Exhibit "F" (the "Detention/Retention Basin") , in conjunction with the first phase development in any portion of Villa del Oro lying in the drainage basin of the Highlands Wash. The Detention/Retention basin will: • • (i) be designed to contain no less than the 10- year storm runoff discharge, under fully developed conditions, from Melcor' s portion of the Highlands Wash drainage basin; (ii) be landscaped along its southern boundary in accordance with plans approved by Highlands Associates; and (iii) be accessible to residents of the Highlands for passive recreation purposes. Any plans proposed by Melcor for the subsequent alteration or reconstruction of the Detention/ Retention Basin shall be subject to review by Highlands Associates. (b) Construct, in conjunction with the Detention/ Retention Basin, a drainage channel, to Pima County standards, with a top width of approximately 115 feet, a landscaping and maintenance area approximately 35 feet wide, and gunite bank protection with natural wash bottom, from Naranja Road to the northerly terminus of the Drainageway. 7 (c) Construct, in conjunction with the Detention/Retention Basin, to Pima County standards, appropriate dikes, berms, weirs and aprons to direct stormwater flow from the Highlands Wash into the Drainageway. (d) Maintain or reduce the rate and velocity of the 100-year storm runoff in the Highlands Wash at the north boundary of the Drainageway, in accordance with calculations approved by Pima County. (e) In conjunction with the construction of the first phase of any residential development in Villa del Oro located north at Lambert Lane, replace the existing substandard drainage structure on Matterhorn Street at the Drainageway with a new multi-cell box culvert with a minimum of three six foot by 10 foot cells and appropriate roadway surface designed to convey storm runoff volumes no less than three times the capacity for stormwater conveyance of the existing structure at Matterhorn Drive, and approximately equal to the capacity of the existing unimproved channel of the Drainageway. To provide access to the portions of the Highlands located east of the Drainageway during construction of the multi-cell box culvert at Matterhorn Drive, Melcor shall construct a 8 "*'-vo,1:40 41,,,fivfv-749;Ai$4,-,,q;$y&,F ittirCit eNY temporary crossing of the Drainageway at Appalachian Street. Melcor shall remove this temporary crossing upon completion of the multi- cell T # „ box culvert, restoring the Drainageway to its pre-existing condition. (f) At the time of residential development by Melcor within 200 feet of the Highlands, construct a six foot masonry wall in or along the edge of the 80 foot buffer strip identified in Exhibit "E", attached hereto, and along the south edge of the Detention/Retention Basin, the exact locations to be mutually determined by Melcor and Highlands Associates. ARTICLE IV. FUTURE INVOLVEMENT OF PIMA COUNTY AND UPSTREAM DEVELOPERS Section 4 .01 With respect to the performance of Highlands Associates and Melcor as described herein, it is the understanding of Melcor and Highlands Associates that Pima County will cause other upstream developers, which control approximately 95 to 97 percent (by acreage or number of residences) of the development potential in the Highlands Wash drainage basin, to implement at their expense similar flood control improvements, including detention/retention and erosion control, in accordance with a basin management study and implementing policies prepared and approved by Pima County. Both Highlands Associates and 9 . Melcor agree that Pima County should implement the foregoing through conditions imposed on the rezoning and development of properties in the Highlands Wash watershed. ARTICLE V. MISCELLANEOUS PROVISIONS Section 5. 01 Release From Liability. Melcor hereby agrees to indemnify and hold harmless Highlands Associates, its officers and employees, from any claims, demands, complaints, suits, losses, damages, injuries and liabilities, which arise by reason of the death or injury of any person or damage to real or personal property, occurring during the construction by Melcor, its employees, agents, or contractors, of the drainage improvements located in the Drainageway and more specifically described in sub-sections 3 .01(a) , (c) and (e) of this Agreement. Section 5. 02 No Representations or Warranties. Melcor and Highlands Associates hereby acknowledge that the new multi-cell box culvert to be constructed by Melcor on Matterhorn Drive at the Drainageway will have a capacity of approximately 1500 cubic feet per second, which is approximately one-half the anticipated flow in the 100-year flooding event under existing conditions on the Highlands Wash watershed. The parties further acknowledge that the Detention/Retention Basin will be designed to reduce the magnitude of the anticipated flow in Highlands Wash at the Northern boundary of The Highlands by approximately 150 cubic feet per second, and to reduce the low flow in Highlands Wash up to the 10-year flooding event. Melcor makes no representations 10 . or warranties to Highlands Associates that any of the improvements to be constructed by Melcor in the Drainageway will provide protection from flooding greater than that described herein. Section 5.03 Default. In the event of any default or other nonperformance of any term or provision of this Agreement, the nondefaulting party shall be entitled to all remedies of enforcement, including the right of specific performance and damages, as well as all other rights and remedies at law in equity, which rights and remedies shall be cumulative and not exclusive. In the event an action is instituted arising out of this Agreement, the party which a court of competent jurisdiction shall deem to have substantially prevailed therein shall be entitled to recover its costs, expenses and reasonable attorneys' fees from the other party.
