La Canada Drive Oro Valley,AZ 85737 Re: Oro Valley Planning and Zoning Department Memoranda Dear Mr. Nodine: As per your previous discussions with Mr. John Madsen,Permit's Administrator for the Arizona State Museum,we are now reviewing the Oro Valley Planning and Zoning Department Memoranda, and doing archaeological records checks for the indicated parcel numbers. Attached please find the results of those records searches. In a few cases, parcel numbers were missing or came up"no matches"on the Pima County Website. If it was possible to determine the approximate location of the parcel(s),then a review for that location was done. If it was not possible to determine the location,no review was attempted. Each review is followed by brief recommendations. Depending on the land form, the surrounding site density, and other factors, the State Historic Preservation Office(SHPO) recommends resurvey for anything surveyed over 10 years ago. In the following recommendations,ASM has used 15 years as a cutoff for resurvey, unless there is sufficient reason to sway the decision one way or the other. If you have any questions,do not hesitate to call me. Church Avenue Tucson, AZ Fax: (520) 628-7637 RE: OV9-03-27,Pre-Application Comments from the October 17, 2003 Development Review Committee for the proposed Rezoning from SR, and R1-144 zones to R1-72 and TP or CN for seven parcels located at the northwest corner of Tangerine Road and La Canada Drive extension. Dear Ms. Volenick: Community Development staff has reviewed the above-referenced pre-application submittal, using the Oro Valley Zoning Code Revised(OVZCR), and we offer the following pre-application comments. Please note that these comments are preliminary in nature due to the preliminary nature of your pre-application submittal. Planning and Zoning Division 1. The OV9-03-27 Rezoning Application is for 7 parcels totaling 38.8 acres; only two parcels lie within the Town of Oro Valley(TOV)jurisdiction. Those two parcels are zoned low density residential (R1-144 District). The 1996 General Plan designates those two parcels as Rural-Low-Density Residential which is reflected in the R1-144 zoning. The Applicant would need to seek and justify a General Plan(GP) amendment from the Planning and Zoning Commission and the Town Council in order to seek and justify a rezoning to a higher density residential and/or commercial use. If the GP amendment is approved, the Applicant may seek a rezoning. Please note that a"TP"District designation would need a General Plan designation of either"Office"or"Commerce Park". Please see Section 8-503 to determine if the TP (Technological Park) designation would allow the uses you may desire in your Project. Please also see Section 8-103 to determine if the CN(Neighborhood Commercial)designation would be better suited for your Project. A CN zoning would require a GP land use designation of"Neighborhood Commercial". Please see www.townoforovalley.com November 25, 2003 Ms. Irene Volenick OV9-03-27, Tangerine and La Canada rezoning Page 2 of 3 Section 4.1.3 of the Land Use Element of the GP to determine which land use designation is best for your Project. Section 3-002 of OVZCR describes the procedures for amending the GP. The next period to apply for a GP map amendment begins the first regular working day of February 2004. 2. The properties not located within the Town limits would need to be annexed prior to seeking a rezoning or a Memorandum of Understanding would have to be developed with the County. Those properties are designated in the GP as Rural Low Density Residential as well. It is suggested that the property owner(s) go forward with an annexation effort. 3. The subject parcels contain a wash listed in the"ESL Riparian Update"data base which has not yet been adopted as part of the OVZCR. Technically, the was is not subject to the OVZCR Chaper 10 Riparian Habitat Protection Overlay District standards. However, as part of a rezoning effort, we would ask that the wash be preserved in accordance with those standards (see Article 10-7 of OVZCR as well as the Open Space and Natural Resources Conservation Element of the General Plan). TOV staff would like the Applicant to avoid vehicular crossing of the wash and would like the Project to be designed in such a way as to place the lowest density uses to the west of the wash(as you have indicated on the preliminary plans) and seek an alternative vehicular access to those portions of the property to avoid a wash crossing. 4. The subject property lies within the Tangerine Corridor Overlay District(TRCOD) which is described in Article 10-0 of OVZCR. Please see Section 10-005 to be certain that the uses and building pad and roadway placements you desire will work within the parameters of TRCOD. 5. Please incorporate plans for circulation that will be compatible with future development to the north and west of the site. TOV Public Works Division, Engineering Comments, from Craig Civalier, dated October 16,2003 1. Provide a site analysis that conforms to Chapter 3, Section 3-104 of the OVZCR 2. It is recommend that the tentative development plan conform to Chapter 4, Articles 4-3, 4-4 and 4-5, Chapter 15, the Grading Ordinance, and Chapter 27 of the OVZCR. 3. Stormwater detention and first flush treatment will be required on this project. 4. All access points to La Canada Drive shall be located per the La Canada Drive Road Improvement Plans, see attached plans. However, if the developer desires the southern most access on La Canada Drive it shall be right in/right out. November 25, 2003 Ms. Irene Volenick OV9-03-27, Tangerine and La Canada rezoning Page 3 of 3 5. The access point on Tangerine Road shall be located to the west property line as far as possible. A deceleration right turn lane shall be provided on Tangerine Road. Any adjustments to the pavement markings shall be the responsibility of the developer. 6. All proposed street right-of-way widths shall be 50-ft. 7. This project shall be designed in conjunction with the Town's La Canada Drive Extension Project and the Tangerine Road Improvement Project. 8. It is strongly recommended that the developer consider the method of providing sanitary sewer to this site. Time is of the essence due to the Town's Tangerine Road Improvement Project. It is desirable to install a sanitary sewer across Tangerine Road before we pave. If this is not possible the sanitary sewer shall be bored across Tangerine Road. 9. An additional 60-ft of right-of-way shall be provided to the Town along Tangerine Road. Other Agency Comments Please see the attached comments from: 1. Pima County Development Services, Maggie Shaw, dated October 10, 2003. We look forward to working with you on this Project.
