HomeMy WebLinkAboutMinutes - Board of Adjustment - 2/23/2021MINUTES ORO VALLEY BOARD OF ADJUSTMENT REGULAR SESSION February 23, 2021 MEETING HELD VIA ZOOM            REGULAR SESSION AT OR AFTER 3:00 PM   CALL TO ORDER Chair Dankwerth called the meeting to order at 3:00 p.m.   ROLL CALL Present: Joseph Affinati, Member Octavio Barcelo, Member Mary Murphy, Member Stephen Roach, Vice Chair Helen Dankwerth, Chair Staff Present:Milini Simms, Principal Planner Joe Andrews, Chief Civil Deputy Attorney Attendees: Steve Solomon, Town Council Liaison PLEDGE OF ALLEGIANCE Chair Dankwerth recited the Pledge of Allegiance to the Board and audience.   CALL TO AUDIENCE There were no speaker requests.   COUNCIL LIAISON COMMENTS Town Council Liaison Steve Solomon stated it was nice to see the Board and welcomed the new member.   REGULAR SESSION AGENDA   1.WELCOME NEW BOARD MEMBER, JOSEPH AFFINATI Chair Dankweth welcomed the newest Board of Adjustment member, Joseph Affinati.   2.REVIEW AND APPROVAL OF THE AUGUST 31, 2020 SPECIAL SESSION MEETING MINUTES       Motion by Member Mary Murphy, seconded by Vice Chair Stephen Roach to approve the minutes as written.   February 23, 2021 Minutes, Board of Adjustment 1  A roll call vote was taken: Member Affinati - Aye Member Barcelo - Aye Member Murphy - Aye Vice Chair Roach - Aye Chair Dankwerth - Aye    Vote: 5 - 0 Carried   3.PUBLIC HEARING: DISCUSSION AND POSSIBLE ACTION REGARDING A VARIANCE REQUEST TO INCREASE THE NORTHERN RESIDENTIAL LOT BOUNDARY WALL HEIGHT TO 8 FEET AT 1582 W COPPER RIDGE DR, CASE NUMBER 2100163       Chair Dankwerth recessed the meeting at 3:07 p.m. to allow staff to assist the applicants with joining the meeting. Chair Dankwerth resumed the meeting at 3:10 p.m. Planner Kyle Packer provided a presentation that included the following: - Purpose - Location map - Applicant's request - Proposed wall height - Five criteria - "Special circumstances" and "not created by owner" criteria - "Preservation grant special privileges" criteria - "Not detrimental to neighborhood or public" criteria - Summary and recommendation Applicants Ron and Marsha Cottrell provided a presentation that included the following: - Objective - View of north wall - Loss of privacy - View showing neighbor in backyard - Actions taken to resolve issue - Answers to the five findings and site plan - Responses to each finding - Views of vegetation and wall - Aerial views of the properties Discussion ensued between the Board and staff. Chair Dankwerth opened the public hearing. There were no speaker requests. Chair Dankwerth closed the public hearing.    Motion by Vice Chair Stephen Roach, seconded by Member Mary Murphy to approve this variance request to increase the northern residential lot boundary wall height to 8 feet at 1582 W Copper Ridge Dr., based on the finding that the five criteria have been met.    A roll call vote was taken: February 23, 2021 Minutes, Board of Adjustment 2  A roll call vote was taken: Member Affinati - Aye Member Barcelo - Aye Member Murphy - Aye Vice Chair Roach - Aye Chair Dankwerth - Aye    Vote: 5 - 0 Carried   4.ELECTION OF THE BOARD OF ADJUSTMENT CHAIR EFFECTIVE FEBRUARY 24, 2021    Motion by Member Mary Murphy, seconded by Member Joseph Affinati to nominate Chair Dankwerth to continue serving as Chair. As there were no other nominations, Chair Dankwerth accepted by acclamation.   5.ELECTION OF THE BOARD OF ADJUSTMENT VICE CHAIR EFFECTIVE FEBRUARY 24, 2021    Motion by Chair Helen Dankwerth, seconded by Member Mary Murphy to nominate Vice Chair Roach to continue serving as the Vice Chair. As there were no other nominations, Vice Chair Roach accepted by acclamation.   ADJOURNMENT    Motion by Member Mary Murphy, seconded by Member Joseph Affinati to adjourn the meeting. Chair Dankwerth adjourned the meeting at 3:47 p.m.     I hereby certify that the foregoing minutes are a true and correct copy of the minutes of the regular session of the Town of Oro Valley Board of Adjustment of Oro Valley, Arizona held on the 23rd day of February, 2021.
