LA CANADA DRIVE CALL TO ORDER: at or after 3:01 p.m. ROLL CALL PRESENT: Paul Parisi, Chair Andy Martin, Member Colleen Kessler, Member John Hickey, Member EXCUSED: Bart Schannep, Vice Chair PLEDGE OF ALLEGIANCE MOTION: Member Kessler moved to APPROVE the minutes from March 27, 2007 meeting. Member Hickey SECONDED the motion. Motion carried, 4-0. MOTION: Member Hickey moved to APPROVE the minutes from April 4, 2007 Special Session. Member Martin SECONDED the motion. Motion carried, 4-0. PUBLIC HEARING: 1. CASE NO. OV10-07-02, PAUL AND KATHY POLITO, REQUEST A VARIANCE FROM THE REQUIRED 18' MAXIMUM BUILDING HEIGHT TO 22'. SUBJECT PROPERTY: (PARCEL # 224-32-0630) 291 W. VALLE DEL ORO, ORO VALLEY, AZ 85737 Chair Parisi swore in the witness. Mariano Rodriguez, 3149 East Terra Alta Boulevard, architect for the project, represented Mr. and Mrs. Polito. Mr. Rodriguez explained that due to the topography of the lot, a variance was needed to raise the roofline of the addition to the home from 18' to 22'. He displayed pictures and drawings noting that the vegetation would make the addition less visible and would not impede the current views of the neighbors to the north, east and west of the property. Member Kessler asked for clarification of the roofline. Mr. Rodriguez explained that the roofline would be three feet higher than the existing house which is 14'. 07/24/07 Minutes, Board of Adjustment 2 However, due to the topography of the lot, the addition from the base to the roofline would be a total of 22'. Zoning Inspector Patty Hayes reported that other locations on the lot were not suitable for the addition. Further, the dense vegetation and the topography minimized views of the addition from adjacent properties. She noted that the addition would not impede neighbors views. Ms. Hayes stated that neighbors have not contacted the Town in favor of or protest of this addition to the Polito's home. Member Hickey had Staff clarify if a different set of rules applied if the building footprint were less than 6%. Ms. Hayes stated that the building height would be measured from finished grade if the topography were flat outside the building versus requiring that the space be filled in to build. Chair Parisi opened the public hearing at 3:10 p.m. There being no speakers, he closed the public hearing. MOTION: A motion was made by Member Hickey to approve Case No. OV10- 07-02, a request to exceed the 18' building height up to but not to exceed 4' when measuring as per the Oro Valley Code. Member Martin SECONDED the motion. Motion to APPROVE Case No. OV10-07-02 carried, 4-0. 2. PLANNING AND ZONING UPDATE Senior Zoning Inspector Dee Widero stated that 75% of the approved buildings of the Oro Valley Marketplace have requested permits. Chief Civil Deputy Attorney Joe Andrews informed the Board that due to Open Meeting Laws, questions could not be posed regarding items that were not posted on the meeting's agenda. ADJOURNMENT MOTION: A motion was made by Member Hickey to adjourn the meeting at 3:12 p.m. Member Kessler seconded the motion. Motion carried, 4-0.
