CALL TO THE AUDIENCE - At this time, any member of the public is allowed to
address the Commission on any issue not listed on today’s agenda. Pursuant to
the Arizona Open Meeting Law, individual Commission members may ask Town
staff to review the matter, ask that the matter be placed on a future agenda, or
respond to criticism made by speakers. However, the Stormwater Utility
Commission may not discuss or take legal action on matters raised during "Call
to the Audience." In order to speak during "Call to the Audience" please specify
what you wish to discuss when completing the blue speaker card.

Town Clerk's Office between the hours of 8:00 a.m. and 5:00 p.m.

INSTRUCTION TO SPEAKERS
Members of the public have the right to speak during any posted public hearing.
However, those items not listed as a public hearing are for consideration and
action by the Stormwater Utility Commission during the course of their business
meeting. Members of the public may be allowed to speak on these topics at the
discretion of the Chair.
If you wish to address the Commission on any item(s) on this agenda, please complete
a blue speaker card and give it to the Recording Secretary. Please indicate on the
speaker card which item number and topic you wish to speak on, or if you wish to speak
during “Call to Audience,” please specify what you wish to discuss when completing the

and Committees: In accordance with Chapter 3, Title 38, Arizona Revised Statutes and
Section 2-4-2 of the Oro Valley Town Code, a majority of the Town Council, Board of
Adjustment, Conceptual Design Review Board, Historic Preservation Commission,
Parks and Recreation Advisory Board, Planning and Zoning Commission, and Water

5.4.6 Provide for safety, efficiency and environmentally sensitive
design in storm water systems. (GP11)
SWUC Discussion: OK.
Recommendation: No change
ACTION ideas
5.4.6.1 Evaluate all public and private development projects
during the review process to determine the effects of
the projects on on‐site and downstream drainage
patterns and associated ecological systems.* (ENV)

SWUC Discussion: We believe this is current practice. OK with deletion of “patterns.”
Recommendation: Delete “patterns.”
5.4.6.2 Design wash crossings to pass the design flow
and to be hydraulically efficient, safe and with minimal physical, traffic or
visual environmental impacts.* (ENV) (GP11)
SWUC Discussion: Visual impacts are normally considered to within environmental impacts, so
we do not see purpose to call out “visualʼ separately unless there is a compelling reason behind
it. Extended discussion about the definition of “wash” and about whether this statement in the
General Plan would force changes in design standards and supersede application of
engineering judgement. If this statement in the General Plan is understood to set conceptual
direction to be achieved through application of standard practices and judgement, then the text
recommended below is likely good. But if this statement in the General Plan would be
understood to establish hard requirements for Town forces and priorities for Town funds, then
some qualifying language would be needed.
Recommendation: With caveat discussed above, replace with “Design wash crossings to pass
the design flow safely and with minimal physical, traffic, visual or environmental impacts.”
5.4.6.3 Require water detention facilities and/or velocity reduction
when necessary to manage storm water in natural drainage
systems.* (GP11)
SWUC Discussion: We believe this is current practice. OK with deletion of “natural.”
Recommendation: Delete “natural.”

5.4.6.4 Rehabilitate and enhance drainage
systems, water detention and retention basins, and
other infiltration areas as part of capital improvements
and, when appropriate, through public‐private
partnerships. (ENV) (GP11)
SWUC Discussion: Extended discussion about what this means and what we think it should
say. Two distinct concepts emerged.
Recommendation: Replace with two action ideas.
- For any capital improvement project in the Town, evaluate, and rehabilitate or enhance as
appropriate, any drainage systems, water detention and retention facilities and other infiltration
areas existing within the project area.
- Include public stormwater structures and facilities in the Townʼs Capital Replacement Plan.
(Need correct term from Aimee R. and Mike T. here.) (We think this second concept is current
practice.)
5.4.6.5 Reexamine current land use designations for areas
susceptible to flood damage and rezone as appropriate
in order to avoid the inappropriate development or
redevelopment of lands and provide for adequate
drainage and reduction of flood damage.* (ENV) (GP01)
SWUC Discussion: Concern that “reexamine land use designations,” unqualified, would create
a labor-intensive project. More fundamentally, strong skepticism that rezoning would be a
prudent or viable alternative. Concerns about provoking takings claims, questions about what
zoning category would be correct, belief that existing Federal, State and local restrictions can be
effective in areas identified as flood-prone. We strongly support the idea of preventing
inappropriate development or redevelopment which would increase risk of flood damage, but
found no consensus to support this concept as we understood it.
Recommendation: Delete this action item, unless there is clear and compelling support within
the Committee.
5.4.6.6 Evaluate storm water management practices
and work programs and if possible align with water
conservation strategies where appropriate. (GP11)
SWUC Discussion: OK with minor edit as shown.
Recommendation: Delete “if possible,” and add “where appropriate.”
5.4.6.7 Continue Develop a maintenance system for publicly-owned
retention basins and stormwater facilities.
SWUC Discussion: We believe this is current practice. OK with edit as shown.
Recommendation: Insert “Continue” in place of “Develop a” and delete “system.”

Suggested POLICY
5.4.7 Integrate innovative storm water management techniques and
education in public and private development or redevelopment
projects and in infrastructure projects. (V01)
SWUC Discussion: Some consideration of changing from “Integrate” to “Incentivize.” Also
discussion of request in Development Committee meeting to consolidate 5.4.6 and 5.4.7 into
one “stormwater” policy. These two policies (5.4.6 and 5.4.7) are distinct concepts which would
lose meaning if consolidated. However, this policy and its action items could be fit into other
development policy areas as suggested below.
Recommendation: Combine this policy statement into 5.3.3, e.g., “Promote and encourage
water conservation and retrofitting programs, and innovative stormwater management
techniques in development or redevelopment projects, infrastructure projects and in landscaped
areas.”
ACTION ideas
5.4.7.1 Integrate green infrastructure and low impact
development techniques into development regulations where appropriate.

SWUC Discussion: OK with addition of qualifier “where appropriate” as shown. This action can
be added to policy 5.3.1 and looks like much the same concept expressed in action 5.3.1.5.
Recommendation: Add “where appropriate” as shown. Move to policy 5.3.1 as stand-alone
action or combine with action 5.3.1.5.
5.4.7.2 Develop a public education program for residents
regarding storm water. (V07)
SWUC discussion: We believe this is current practice. Edit to reflect current practice, as
shown.
Recommendation: Replace with “Provide public education about stormwater.” This action can
be added to policy 5.3.3 as a stand-alone action or combined into 5.3.3.1.
5.4.7.3 Study and explore opportunities for the creation of
stormwater recharge facilities to assist in replenishing groundwater.
SWUC discussion: OK with language changed as shown below. This action is similar to, and
might be considered included in, action 5.4.7.4 (following). These two actions (5.4.7.3 and
5.4.7.4) are maintained separate because of distinct interest expressed in the Development
Committee to emphasize groundwater recharge and also to emphasize multi-benefit projects.
This distinction was not considered significant in our discussion.
Recommendation: Replace with “Identify and investigate opportunities for
creation of facilities which use stormwater to recharge groundwater. This action can be added
to policy 5.3.1 and could logically be combined into action 5.3.1.6.

5.4.7.4 Study options for multi-benefit stormwater facilities
which may manage water, provide habitat and recharge groundwater.
SWUC discussion: OK with language changed as shown below, with ʻrecreation” added to list
of examples. Similarity with action 5.4.7.3 is discussed above.
Recommendation: Replace with: “Study options for facilities having
multiple benefits which may include, e.g., stormwater management, recreation,
wildlife habitat and groundwater recharge.” This action can be added to policy 5.3.1 and could
logically be combined into (or replace) action 5.3.1.6.
