CALL TO ORDER ROLL CALL CALL TO THE AUDIENCE- At this time, any member of the public is allowed to address the Commission on any issue not listed on today’s agenda. Pursuant to the Arizona Open Meeting Law, individual Commission members may ask Town staff to review the matter, ask that the matter be placed on a future agenda, or respond to criticism made by speakers. However, the Stormwater Utility Commission may not discuss or take legal action on matters raised during "Call to the Audience." Bennett SUBJECT: Calendar Requirements for ADEQ Small MS4 Permit Adopted September 30, 2016 The Arizona Department of Environmental Quality (ADEQ) adopted a new Small MS4 General Permit AZG2016-002 which established new minimum requirements. Many of these new requirements or conditions must be implemented prior to March 29, 2017 or September 30, 2017. The purpose of this Memorandum is to briefly identify the things that must be done, and the corresponding dates they must be completed. These minimum compliance dates are listed in the table below, and again in an itemized list that follows. New compliance dates. Notice of Intent: NOI Due 180 days after permit begins. Section 2.1.1 Due, March 29, 2017. 2. Stormwater Management Program: Existing permittees shall modify or update their existing SW MP to meet the terms and conditions of this permit within six (6) months of the effective date of this permit. Section 5.0 Due, March 29, 2017. 3. Effluent Limitations and Surface Water Quality Standards: The permittee shall develop, implement and enforce a program to reduce the discharge of pollutants from the MS4 to the m aximum extent practicable, to protect water quality, and to satisfy the appropriate water quality requirements of the Clean W ater Act and the Arizona Surface W ater Qualit y Standards. The permittee shall implement the six (6) minimum control m easures specified in Part 6.4 to the maximum extent practicable to protect water qualit y, an d to satisfy water quality requirements of the Clean W ater Act, including attainment of surface water qualit y standards. Sections 6.0 & 6.2 Due, March 29, 2017. 4. Illicit Discharge Detection and Elimination (IDDE) program: For existing perm ittees, the written illicit discharge detection and elimination plan shall be completed within six (6) months of the effective date of this permit. Section 6.4.3 Due, March 29, 2017. 5. Visual Dry & Wet Weather Outfall Monitoring: W ithin six (6) months of obtaining authorization to discharge, the permittee shall develop and implement a visual, dry & wet weather outfall m onitoring program. Section 6.4.3.8 Due, March 29, 2017. 6. Pollution Prevention and Good Housekeeping for Municipal Operations: The permittee must develop, implement, and maintain an operations and maintenance program. Existing permittees must continue to implement established operation and m aintenance programs while updating those programs, as necessary, to comply with the requirem ents of this permit. Program updates must be developed and implemented within six (6) months of obtaining permit coverage. Section 6.4.6 Due, March 29, 2017. Stormwater Engineering Division Page 3 of 4 7. Update Mapping of the MS4 Assets: Within 12 months of this permits effective date, existing perm ittees shall update map(s) to include areas added as a result of the most recent Decennial Census (including annexed areas) and annually thereafter. Updates shall include mapping com ponents identified in Section 4.1 above. Section 4.2 Due, September 30, 2017. 8. Construction Activity Stormwater Runoff Control: The procedures for site plan reviews considering potential water qualit y impacts as they pertain to construction activity, shall be com pleted within one (1) year of this permits effective date. Section 6.4.4.2 part h Due, September 30, 2017. 9. Site Plan Review Protocol: 180 days from date the NOI is submitted to ADEQ a site plan review shall include, a review b y the permittee of the site design, the planned operations at the location of the construction activity, planned storm water controls during the construction phase, and the planned controls to be used to manage runoff created after developm ent. Section 6.4.5 Due, September 30, 2017. 10. Post-Construction Stormwater Control Inventory: W ithin the first year of the effective date of this permit, the permittee shall implement and maintain an inventory s ystem of all post -construction structural stormwater control measures installed and im plemented at new development and redeveloped sites. Section 6.4.5.3 Due, September 30, 2017. 11. Program Assessment, Record Keeping & Reporting: The permittee shall annually self-evaluate its compliance with the terms and conditions of this permit. The permittee shall maintain the annual evaluation documentation as part of the SW MP. The permittee shall include this information in the annual report. Section 8.0 Due, September 30, 2017. 12. Annual Report: The permittee shall submit an annual report each year of the permit term to ADEQ. The reporting period is from July 1 through June 30 each year. The annual report is due to ADEQ on or before each year for the reporting period. The annual reports shall contain the following information. Section 8.4 Due, September 30, 2017. 13. Update Local Ordinances: Within 24 months of this permits effective date, existing and new perm ittees shall adopt and implement local ordinance(s) or other regulatory m echanism(s) that provide adequate enforcement procedures which satisfy the requirem ents of this permit to control pollutan t discharges into its MS4. Enforcement Response Plan: Within 24 months of this permits effective date, the permittee shall develop an enforcement response plan (ERP) that specifies how it will exercise its legal authority to comply with this permit. Section 3.3 Due, September 30, 2018. 15. Regulatory Mechanism for Post-Construction Stormw ater Controls: Permittees must evaluate existing ordinances or other regulator y m echanisms to address post-construction stormwater runoff from new development and redevelopment projects. If it is determined existing ordinances or other regulator y mechanisms must be modified, the permittee must develop, adopt and implement a revised ordinance or other mechanism within the tim efram e specified in Part 3.1 (24 months). Section 6.4.5.1 Due, September 30, 2018. 16. Record Keeping: The permittee shall keep all records required by this permit for a period of at least three (3) years. Records include information used in the development of any written program required b y this permit, any monitoring results, copies of reports, records of screening, follow-up and elimination of illicit discharges; maintenance records; inspection records; enforcement actions; and data used in the development of the notice of intent, SW MP, plans, and annual reports. This list provides examples of records that should be m aintained, but is not all inclusive. Section 8.2 Due, September 30, 2019.
