Councilmember Jones-Ivey stated that as this would be her last meeting as Liaison to the Stormwater Utility Commission she would like to thank everyone very much, she learned a lot, and that she has the highest level of confidence in the work done by the Commission and Stormwater Utility. She also appreciates everyone's commitment and hard work. Assistant Director/Public Works Aimee Ramsey thanked Councilmember Jones-Ivey for her time and effort as Council Liaison to the Stormwater Utility Commission. Thank you's were added from Commissioners and staff present.   REGULAR SESSION AGENDA   1.REVIEW AND APPROVAL OF THE OCTOBER 17, 2019 MEETING MINUTES       Motion by Commissioner Jack Stinnett, seconded by Commissioner Richard Hawkinson to approve the 11/21/19 Minutes, Stormwater Utility Commission Regular Session 1  Motion by Commissioner Jack Stinnett, seconded by Commissioner Richard Hawkinson to approve the October 17, 2019 regular session minutes as written.  Vote: 4 - 0 Carried   2.DISCUSSION OF STORMWATER MEETINGS AND EVENTS       Senior Engineer Justin Turner and Assistant Director/Public Works Aimee Ramsey reported on Stormwater meetings and events.   3.DISCUSSION OF ONGOING FEMA-GRANT APPLICATION FOR CATALINA RIDGE 2019 PRE-DISASTER MITIGATION (PDM)       Discussion ensued among the Commissioners and staff regarding the fact that the SWU application was not selected but was put on the wait list, and as to the low ranking status of this FEMA-Grant application.   4.DISCUSSION OF TWO ONGOING 2019 PRE-DISASTER MITIGATION (PDM) FEMA-GRANT APPLICATIONS FOR LOWER HIGHLAND WASH CHANNEL RECONSTRUCTION       Mr. Turner reported that the two ongoing PDM FEMA-Grant applications for Lower Highland Wash Channel Reconstruction and Lower Highland Flood Control Project were not selected, and instead placed on the wait list with ranks of 9 and 2 respectively. An update has been received that the Lower Highland Flood Control Project application is now number 8 on the preferred list, and we are moving forward with the submittal of this project.   5.DISCUSSION OF ONGOING FEMA-GRANT APPLICATION FOR LAMBERT LANE DIP CROSSING RECONSTRUCTION, PHASE 2       Staff reported on the ongoing FEMA-GRANT Application for Lambert Lane Dip Crossing Reconstruction, Phase 2. Mr. Turner reported that 5 (five) solicited bids were received, the bids came in favorably, and we will report the contractor selected at our next meeting. Ms. Ramsey stated that work may begin the beginning of the year (2020) with possibly a 3-month window for completion, and may be near completion in time for the SWUC Spring Field Trip. Commissioner Brown asked if this project fell under the push to have shovel ready projects that had been discussed last year. Ms. Ramsey said this was a direct result of that push.   6.DISCUSSION AND POSSIBLE ACTION REGARDING THE CANCELLATION OF THE DECEMBER 19, 2019, SWUC REGULAR SESSION MEETING       Motion by Commissioner Richard Hawkinson, seconded by Commissioner Jack Stinnett to approve the cancellation of the December 19, 2019 Stormwater Utility Commission Meeting.  Vote: 4 - 0 Carried    Chair DeSantis stated that the next Stormwater Utility Commission meeting would be January 16, 2020 in the Council Chambers.   FUTURE AGENDA ITEMS    Future agenda items were discussed and agreed upon as follows: Welcoming of Councilmember Bill Rodman as the new SWUC Liaison Introduction of John Spiker, P. Meeting Date:01/16/2020   Submitted By:Justin Turner, Public Works SUBJECT: DISCUSSION OF RESULTS OF NOVEMBER 13, 2019 TOWN OF ORO VALLEY MS4 AUDIT BY ADEQ RECOMMENDATION: N/A EXECUTIVE SUMMARY: SMALL MUNICIPAL SEPARATE STORM SEWER SYSTEM (MS4) AUDIT On November 6, 2019, the Arizona Department of Environmental Quality (ADEQ) notified the Stormwater Utility that they would be conducting a 5-year audit of the Town’s MS4 Program one week later on November 13th. The MS4 program is a Federal mandate under the Clean Water Act (33 U.S.C. 1251 et seq.), National Pollutant Discharge Elimination System Regulations (40 CFR Part 122) and State of Arizona regulations for stormwater discharge (ARS Title 49, Chapt. 2, Art. 3.1). We were told the audit would be used to evaluate the Town's overall stormwater management program implementation, and identify problems we may have in implementing the program. Further, the MS4 audit would involve an on-site visit and comprehensive review of the MS4 owner/operators stormwater management program including the legal authority, procedures, implementation of procedures, and adequate resources, where applicable, for the following program elements:  (1) structural and source control measures (2) detection and removal of illicit discharges and improper disposal into storm sewers;  (3) monitoring and controlling pollutants in stormwater discharges (4) implementing and maintaining structural and nonstructural best management practices (BMPs) (5) implementation schedules and assignment of appropriate individuals (6) the inspection and enforcement program for covered industrial facilities and construction sites  (7) the dry weather screening program. To help us prepare, ADEQ gave us an Audit Agenda, as well as a copy of the Audit Report Form requesting specific information found in the Town's Stormwater Management Program and latest MS4 Annual Report.  We were also asked to select two representative active construction sites where staff is currently conducting SWPPP inspections. The results of the audit were six minor items and one recommendation. All items have been addressed and the revised  Stormwater Management Program (SWMP) was returned to ADEQ on November 20th and we received ADEQ acceptance on November 21, 2019.  In general, the revisions were related to:  Added a process and schedule for creating and maintaining an up-to-date map (storm sewer system, outfalls, receiving waters)  Fixed Section II (Page 5) of the SWMP that was incorrectly directing additional BMP information to “Attachment E” instead of “Attachment D”  Made Responsible personal more specific in “Attachment D” of SWMP for implementation of each BMP Created written statement identifying staff and department responsibilities for eliminating illicit discharges in Attachment F - Table 1 IDDE Program Created written process and procedure to identify, mitigate, and report illicit discharges  Municipal facilities are now prioritized for inspections based on pollutant discharge risk The updated SWMP can now be found on the Town's webpage. Meeting Date:01/16/2020   Submitted By:Justin Turner, Public Works SUBJECT: DISCUSSION OF 2019/2020 TOWN OF ORO VALLEY MS4 COMPLIANCE SCHEDULE, SECOND QUARTER REPORT RECOMMENDATION: This report is for informational purposes only.  No action is required to be taken. EXECUTIVE SUMMARY: Town’s Stormwater Management Plan and Annual Report to ADEQ (see the Town’s web page for copies) identify Minimum Control Measures (MCM’s) used to manage and control quality of stormwater runoff from the MS4.  Each MCM has been given specific implementation dates and frequencies, measurable goals, and responsible departments.      This memorandum is a report on the Town’s Stormwater Management Program for the second quarter of the Annual Reporting Period for 2019-2020 (October 1st through December 31st).  It has been prepared to keep stakeholders informed of the status of project implementation in terms of completed tasks that are either (1) ongoing or continuous, or (2) to be done a minimum of once each year.    Accompanying this Memorandum is a summary Table listing each of the six (6) required MCM’s along with their specific subset of Best Management Practices (BMP’s).   This summary Table shows that the Stormwater Utility is fully up to date, and has met this quarter’s goals for implementing BMP’s that are ongoing and continuous.   BACKGROUND OR DETAILED INFORMATION: The Town of Oro Valley (Town) manages stormwater quality in accordance with the Arizona Pollutant Discharge Elimination System (AZPDES) Permit AZG2016-002 that authorizes the discharge of stormwater from the municipal separate storm sewer system (MS4) to receiving waters, including Waters of the United States (WOTUS).  The MS4 generally consists of roads, storm drains, and infrastructure carrying runoff into drainage ways or ephemeral stream channels. The Town of Oro Valley has a Stormwater Management Program (SWMP) that describes the control measures it uses to manage the quality of discharges from the MS4. These Best Management Practices (BMPs) are:               MCM-1.           Public Education and Outreach             MCM-2.           Public Participation and Involvement             MCM-3.           Illicit Discharge Detection and Elimination             MCM-4.           Construction Site Runoff Control             MCM-5.           Post-Construction Runoff Control             MCM-6.           Pollution Prevention/Good Housekeeping for Municipal Operations   The Town’s Stormwater Management Plan describes specific practices it uses to achieve compliance with Part 6.4 of the AZPDES Permit related to Minimum Control Measures, including specific implementation dates and frequencies, measurable goals, and responsible departments.  Our staff keeps track of these thirty-three (33) targeted responsibilities, and has prepared the attached summary table showing project implementation in terms of completed tasks that are either (1) ongoing or continuous, or (2) to be done a minimum of once each year.    This attached summary Table shows that the Stormwater Utility is fully up to date, and has met this quarter’s goals for implementing BMP’s that are ongoing and continuous   The next scheduled update will be prepared and distributed sometime after March 31, 2020. Meeting Date:01/16/2020   Submitted By:Justin Turner, Public Works SUBJECT: DISCUSSION REGARDING THE ONGOING 2019 PRE-DISASTER MITIGATION (PDM) FEMA-GRANT APPLICATION STATUS OF THE LOWER HIGHLAND WASH FLOOD CONTROL PROJECT RECOMMENDATION: N/A EXECUTIVE SUMMARY: LOWER HIGHLAND WASH FLOOD MITIGATION The Stormwater Utility has been notified by the State of Arizona Department of Emergency and Military Affairs that the Highland Wash Flood Mitigation project has been listed as “competitive” under Arizona’s Hazard Mitigation Assistance grant application process. This listing means that this project will be one of several representing the State of Arizona in the national competition for Federal Emergency Management Agency (FEMA) funding under their Pre-Disaster Mitigation grant program. The SWU will be submitting its final application to DEMA by January 10, 2020 for their submission to FEMA. The grant, if ultimately selected at the national level, would cover 75% of the approximate $2 million cost of the project. In addition, the Stormwater Utility recently reviewed and commented upon the Drainage Report, Design Concept Report, and 65% Construction Plans for this project, and we are expecting completed documents back from the Engineer in sufficient time for these documents to be included a part of the Town's grant-application package. Meeting Date:01/16/2020   Submitted By:Justin Turner, Public Works SUBJECT: DISCUSSION OF THE SPRING 2020 STORMWATER UTILITY COMMISSION FIELD TRIP RECOMMENDATION: N/A EXECUTIVE SUMMARY: The goal of this year's field trip is to visit places in Oro Valley that will give the Commissioners a better understanding of the broad range of activities typically performed by the Stormwater Utility.  Possible sites to be visited may include places where the following activities occur. •Public Drainage Infrastructure Inspection (MS4), Maintenance & Repair •Private Drainage Infrastructure Inspection, Maintenance & Repair •SWPPP Inspections (current construction projects) •SWPPP Inspections (verification of post-construction control measures) •Illicit Discharge Detection and Elimination (IDDE): Enforcement Action •Drainage Complaints: Evaluation and Response •Capital Improvement Projects: Selection, Design and Construction Oversight •Coordination with Pima Co. Regional Flood Control District: LOMR’s, Studies, and Watercourse Maintenance •Verification of Municipal Operation’s Good-Housekeeping Practices Last year's visit took us to eleven locations over a period of three hours starting at 7:00 AM.  Beforehand we took a group photograph, and this year we would like to do the same.  The time, date, and locations to be visited this year are to be determined in the coming weeks by staff for public notification.  And as before, no official Town business will be conducted at this function.   BACKGROUND OR DETAILED INFORMATION: N/A FISCAL IMPACT: N/A SUGGESTED MOTION: N/A    Stormwater Utility Commission 9.
