INSTRUCTIONS TO SPEAKERS
Members of the public have the right to speak during any posted public hearing. However, those items
not listed as a public hearing are for consideration and action by the Commission during the course of
their business meeting. Members of the public may be allowed to speak on these topics at the discretion of
the Chair.
In accordance with Amendment #2 of the Mayoral Proclamation of Emergency issued on March 27, 2020,
the following restrictions have been placed on all public meetings until further notice:

Division Manager John Spiker reported on the following subjects:
A draft of the Drainage Criteria Manual has been sent out to a select group of experts, internal Oro Valley
staff, and colleagues at Pima County Flood Control District (PCFCD) for comments.
A request for updates on the Naranja Trails Subdivision, a development proposed due north of the
Highlands Mobile Home Park, was referred to the Oro Valley Planning website for updates and the
Planning and Zoning Commission for their Public Meetings. The Stormwater Utility (SWU) will be providing
a review of the drainage / watershed study associated with any development that is ongoing.

approve the status quo base rate for the Stormwater Utility for 2020/2021.

3.RECOGNITION OF OUTGOING STORMWATER UTILITY COMMISSIONER RICHARD HAWKINSON
Commissioner Hawkinsons' Stormwater Utility Commission (SWUC) term ends 12/31/20. Staff and
Commissioners thanked Commissioner Hawkinson for his service, with sincere appreciation for all he
has done over the years for the SWU. His support of the Commission was acknowledged, along with
the insight that he shared with the entire commission.

5.REPORT AND DISCUSSION OF THE FLOODPLAIN STATUS APPLICATION ON THE TOWN'S
WEBSITE
SWU GIS Analyst Scott Bennett presented an introduction to the newly created Stormwater Utility

SWU GIS Analyst Scott Bennett presented an introduction to the newly created Stormwater Utility
Floodplain Status application on the Towns' website and walked the Commission through the
experience a user resident would have accessing the map application to view the flood plain status
of any particular Town property. The application is interactive and user friendly. The flood-hazard
information from this new web mapping application can also be printed or saved electronically as a PDF
file.
6.DISCUSSION AND POSSIBLE ACTION REGARDING SUPPORT FROM THE STORMWATER UTILITY
COMMISSION FOR THE STAFF REQUEST TO TOWN COUNCIL FOR EXPENDITURE OF FUNDS
FOR THREE (3) MINOR DRAINAGE REPAIR AND/OR REHABILITATION PROJECTS
Mr. Spiker reminded the Commissioners that the SWU staff was not asking for approval of the projects
but for approval of support for the SWU staff to bring these projects before the Town Council.
SWU Project Manager John Lynch presented on three (3) small maintenance projects to the
Commission. Because these projects are funded through contingency funds in the Stormwater budget,
they require the SWU to take the projects to Mayor and Council for their approval of the expenditure of
these funds. The proposed project issues presented were:
Erosion issues with the equestrian trail in the Logan's Crossing subdivision
Erosion and sediment deposition in an area located in the Lomas Del Oro subdivision along
Camino Bajio and Paseo Cordona
Runoff from a drainage apron that has exacerbated erosion at Tangerine Road, just west of
Water Harvest Way at the Oro Valley Marketplace where two multi-use paths connect
Discussion ensued between staff and the Commissioners. Commissioners commented that the
projects were worthwhile and that the repair and/or rehabilitation seemed very well planned out.
Motion by Commissioner Richard Hawkinson, seconded by Vice Chair Joan Brown to approve
supporting the SWU staff to request the Town Council to expend funds for three (3) drainage
improvements.

Discussion ensued among the Commission and staff regarding the 2021 SWUC meeting schedule. The
schedule was reviewed with the understanding that a meeting could be potentially targeted to be
cancelled.

The Stormwater Utility Commission (SWUC) is an advisory board to the Town Council on matters related to the
stormwater and floodplain management activities intended to meet state and federal requirements. The SWUC
plays an important role in this endeavor by studying staff reports regarding ongoing activities performed by the
Stormwater Utility (SWU). This information is used annually to review projected stormwater expenditures, and to
recommend to the Town Council adjustments to the SWU Fee, if needed. In order to help the new Commissioners
and Council Liaison, the remainder of this staff report briefly describes the general regulatory function of the
Stormwater Utility, as well as the specific duties of the Commission.
BACKGROUND OR DETAILED INFORMATION:
Among its numerous municipal duties and functions, the Town of Oro Valley (Town) manages stormwater quality
in accordance with the Arizona Pollutant Discharge Elimination System (AZPDES) Permit AZG2016-002 that
authorizes the discharge of stormwater from the municipal separate storm sewer system (MS4) to receiving
waters, including Waters of the United States (WOTUS). In order to help meet regulatory obligations, the Town
adopted its first Stormwater Ordinance in 2001, and amended it 2007 and 2010 (Town Code Article 15-24), that
included the following significant provisions:
Creation of a Town-owned Stormwater Utility (TC 15-24-2.B) with oversight over all stormwater conveyance
facilities owned by, or dedicated to, the Town (TC 15-24-9), with authority to adopt a Stormwater Utility Fee
to fund implementation of a Stormwater Management Program (TC 15-24-13.B), and for the Town Council,
with recommendations received from the Commission, to determine how funds are to be expended (TC
15-24-10).

The Stormwater Utility is responsible for meeting all quality and quantity regulations and issues including the
Town's Stormwater Management Plan, Floodplain and Erosion Hazard Management, and supporting all
other Town programs that are impacted by stormwater runoff. The SWU also coordinates with Federal, State
and local government agencies related to the Town's Stormwater program.
Typical Stormwater Utility Activities Include:
Implementation of all MS4, Arizona Department of Environmental Quality (ADEQ) and Environmental
Protection Agency (EPA) requirements including Illicit Discharge Detection and Elimination, Stormwater
Pollution Prevention Plan (SWPPP) review, SWPPP field inspections, and Public Education and Outreach
(Quality)
Storm System Inspections, Maintenance and Repair, including post-storm maintenance, of culverts, basins,
grade control structures, storm sewer inlets/outlets and drainage channels (Quantity)
Technical Support for other divisions within the Town (Quality/Quantity)
In-House Hydrologic and Hydraulic Studies and Designs (Quantity)
Floodplain Permit Review for compliance with National Flood Insurance Program (NFIP) rules
(Quantity/Quality)
Development Review (Quantity/Quality)
Coordination with other local jurisdictions including the Pima County Regional Flood Control District
Preparing and Revising/Updating Town Ordinances and Manuals (Quality/Quantity)
Stormwater Utility administration including Equivalent Residential Unit (ERU) billing
Creation of Stormwater Utility Commission (TC 15-24-6) with the specific responsibility to annually
review the Stormwater Utility revenue requirements and recommend to the Town Council rate
adjustments as necessary (TC 15-24-13.H), and to review and approve adjustments to, and
appeals for corrections of, the Utility Fee (TC 15-24-13.G and L), and with Commissioners
expected to adhere to normal Rules of Procedure (TC 3-6-4).

Adoption of a Stormwater Management Program(TC 15-24-8) that outlines the goals and objectives of
the stormwater system and identify the various elements of the system necessary to achieve the
goals.

Adoption of an Illicit Discharge and Elimination Program (15-24-14.H, K and L) that describes
procedures to systematically find and eliminate sources of non-stormwater to its municipal
separate storm sewer system and to implement procedures to prevent illicit connections and
discharges.

As an advisory commission to the Town Council, the SWUC meets to give guidance and support to the
Stormwater Utility as it relates to the stormwater and floodplain management activities. The intent is for
the Stormwater Utility to implement programs and practices to meet the requirements of the EPA and
ADEQ permits.

QUARTER REPORT
RECOMMENDATION:
This report is for informational purposes only.
EXECUTIVE SUMMARY:
The Town of Oro Valley's (Town) Stormwater Management Program and Annual Report to ADEQ identify
Minimum Control Measures (MCM’s) used to manage and control quality of stormwater runoff from the MS4. Each
MCM has been given specific implementation dates and frequencies, measurable goals, and responsible
departments.
This memorandum is a report on the Town’s Stormwater Management Program for the second quarter of the
Annual Reporting Period for 2020-2021 (July 1st through June 30th). It has been prepared to keep stakeholders
informed of the status of project implementation in terms of completed tasks that are either (A) ongoing or
continuous, or (B) to be done a minimum of once each year.
Accompanying this Memorandum is a summary Table listing each of the six (6) required MCM’s along with their
specific subset of Best Management Practices (BMP’s).
This summary Table shows that the Stormwater Utility is nearly up to date, and, with one possible exception, has
met this quarter’s goals for implementing BMP’s that are ongoing and continuous. The one deficiency is BMP 1.5
“Outreach Events at Town of Oro Valley Schools", and which understandably will not happen anytime in the
foreseeable future.
BACKGROUND OR DETAILED INFORMATION:
The Town manages stormwater quality in accordance with the Arizona Pollutant Discharge Elimination System
(AZPDES) Permit AZG2016-002 that authorizes the discharge of stormwater from the municipal separate storm
sewer system (MS4) to receiving waters, including Waters of the United States (WOTUS). The MS4 generally
consists of roads, storm drains, and infrastructure carrying runoff into drainage ways or ephemeral stream
channels. The Town has a Stormwater Management Program (SWMP) that describes the control measures it
uses to manage the quality of discharges from the MS4. These Best Management Practices (BMPs) are:
MCM-1. Public Education and Outreach
MCM-2. Public Participation and Involvement
MCM-3. Illicit Discharge Detection and Elimination
MCM-4. Construction Site Runoff Control
MCM-5. Post-Construction Runoff Control
MCM-6. Pollution Prevention/Good Housekeeping for Municipal Operations
The Town’s Stormwater Management Program describes specific practices it uses to achieve compliance with Part
6.4 of the AZPDES Permit related to Minimum Control Measures, including specific implementation dates and
frequencies, measurable goals, and responsible departments. Our staff keeps track of these thirty-three (33)
targeted responsibilities, and has prepared the attached summary table showing project implementation in terms of
completed tasks that are either (A) ongoing or continuous, or (B) to be done a minimum of once each year.
This attached summary Table shows that the Stormwater Utility is fully up to date, except for BMP 1.5, and has met
this quarter’s goals for implementing BMP’s that are ongoing and continuous
The next scheduled update will be prepared and distributed sometime after the 3rd quarter ends on March 31st,
2021.

EXECUTIVE SUMMARY:
In 2018 the Catalina Shadows Home Owners Association approached the Town of Oro Valley Stormwater Utility as
well as the Pima County Regional Flood Control District in regard to significant slope erosion occurring behind
properties within the neighborhood. Investigations revealed this to be a private property issue, but the Town and
County remained engaged with the HOA to provide guidance of the mitigation project to ensure no adverse impacts
to Big Wash or the adjoining properties. The coordination by the HOA with both the Town and County should be
recognized as a success and demonstrates the outreach efforts both agencies provide to assist these types of
private endeavors.
BACKGROUND OR DETAILED INFORMATION:
Catalina Shadows in a 30+ year old subdivision near the northeast end of Palisades Road overlooking the Big
Wash. The majority of the subdivision drainage empties into Big Wash. Significant slope erosion was identified in a
2018 site observation report completed by the HOA consultant Bogardus Engineering Company behind a home
located at 1794 N. Moonshroud Drive above Big Wash.
The HOA commissioned Jim Evanoff with Ground Support Engineering in 2019 to perform a soil evaluation and
develop potential mitigation strategies to overcome the issue.
The plans, completed in 2020, identified the removal and re-compaction of the slope with additional best
management practices to maintain slope stability as the most efficient means of mitigation. In addition to the slope
mitigation, Pima County was engaged as the primary property owners of the Big Wash Preserve as well as the
Pima County Regional Wastewater Reclamation Department which has sanitary sewer facilities in the area. The
Town of Oro Valley remained engaged to ensure stormwater quality and quantity mandates were upheld.
Construction was awarded to Rockridge Construction by the HOA in Summer of 2020 with work
beginning August 10, 2020. 2,275 tons of dirt were imported to the site and re-compacted to mitigate the failed
slope. Straw wattles and hydroseed were placed on the finished slope to assist in slope stability and minimize
erosion. Work was completed in October 2020 with continued monitoring of the project moving into 2021.
Total costs borne by the HOA for site investigations, plans, specifications, and construction was $149,560.85.
The Town would like to recognize the tremendous efforts of the Catalina Shadows HOA in identifying the issue,
formulating a mitigation plan, and the continued coordination and communication with all parties involved.
