CONSENT AGENDA
B. OV13-07-22, Profile Design Inc., representing the Rock Ridge Apartments,
requests architectural approval for remodeling of the existing clubhouse,
located off Pusch View Lane just west of Oracle Road. The site is zoned

C. OV13-07-20, NCH Corporation, represented by Olsson Associates,
requests approval for three models for the residential development known
as "Stone Villas", located on the northeast corner of Rancho Vistoso
Boulevard and Morning Vista Drive. The parcel number is 219-20-001C; the
proposal is for three residential condominium models and the site is zoned
Rancho Vistoso Planned Area Development High Density Residential

The Consent Agenda was approved unanimously by general consent of the
Board.
REGULAR AGENDA
A. Review and approval of the July 30, 2007 Development Review Board
minutes.
Chairman Zinkin requested two changes to the July 30, 2007 minutes. The DRB
Meeting on July 30, 2007 was a Special Session not a Regular Session as
indicated. The minutes read that Member Leska voted against the approval of
the minutes, Mr. Leska voted in favor of approval as submitted.
MOTION: A motion was made by Scott Leska, Member and seconded by Mary
Caswell, Member to approve the July 30, 2007 minutes as amended.
MOTION carried, 5-0.
1. Continued Item: OV13-07-18, Richmond American Homes, representing
the owner and applicant, requests approval of architectural elevations for
two model homes within the Ram's Pass Subdivision, located in proximity
to the southeast corner of Oracle Road and Ram's Pass. The zoning for
the subdivision is R-4, single family dwellings attached/detached. If you

Applicant RoyGolder, Richmond American Homes, made his presentation to the

DRB. Mr. Golder reviewed the plans and stated the plans meet the setback
requirements.
David Ronquillo, OV Senior Planner, presented the staff report. Mr. Ronquillo
reviewed the following:

Staff recommended approval with no conditions.
Member Shelton stated the garage exceeded the 50% allowed.
Mr. Ronquillo responded the developer is providing mitigation by providing
courtyard walls that are not optional.

2. Continued Item: OV13-07-09, Gee Properties 1, LLC., representing
Yokohama Asian Express, request approval of a color revision for
Yokohama Asian Express, located at 8060 N. Oracle Road. This item was
continued at the July 30, 2007 Development Review Board meeting. The
parcel number is 225-14-0520; the application is for a color revision to the
Yokohama Asian Express building. If you have any questions about this

Teri Sterling presented a color revision request for Yokohama Express at 8060

Pamela Pelletier, OV Planner presented the staff report and reviewed the

Mrs. Pelletier stated staff recommended approval.
Member Caswell asked if the colors were a trademark. The applicant
responded the colors are the chosen corporate colors and not a trademark.
Member Caswell stated the General Plan requires harmonious and the
proposal is shocking and not harmonious.
Mrs. Pelletier stated staff is hoping to encourage others in the area to come into
compliance and to use a more expanded and vibrant color palette.

Member Caswell asked if staff was saying that we want to adopt new vibrant
colors for Oro Valley.
Mrs. Pelletier stated that is the direction that staff was given.
Member Zinkin asked Lexa Mack, OV Civil Attorney, if the direction give to staff
meant the DRB had to take the same direction. Mrs. Mack responded no.
MOTION: A motion was made by Scott Leska, Member and seconded by John
Buette, Member to approve OV13-07-09 a color revision for Yokohama Asian

did not agree with the Planning and Zoning Director
on the selection of colors.

vote against the motion.
Member Leska stated the Town needed diversity.
Member Buette stated the same colors had been used in the area.

4. OV13-0 7-21 J.P. Morgan Chase, represented by GDA Architects, requests
approval of architecture for the Chase Bank at the Oro Valley Marketplace,

Road. The parcel number is 220-04-3020; the request is for architecture
elevations for the bank. The site is zoned Rancho Vistoso Planned Area

Chairman Zinkin informed the Board that two votes would be required on this
item, one for development and one for landscape.
David Little, WLB Group, made the presentation to the DRB and reviewed the
Project Team.
Beth Koch, OV Resident, presented the Tucson Research Center history and
background round and stated the company is a product development facility and has
outgrown their current facility.

Mr. Michels stated that staff found the proposal is in compliance with the General
Plan, PAD and the Tangerine Road Overlay and recommended approval with the
conditions in Exhibit A.
Mr. Michels confirmed that construction of the access road would not change the
water flow.
Bill Adler, OV Resident. Mr. Adler opined this proposal is a first for a developer
to utilize the LEED standards and encouraged as little irrigation as possible.
MOTION: A motion was made by John Buette, Member and seconded by Mary
Caswell, Member to approve OV12-06-29, Development Plan for Sanofi Aventis,
subject to the conditions in Exhibit A, and including approval of the land swap.

parcel number is 219-20-826A. The site is 11.54 acres in size and the

Matt Michels, OV Senior Planner, presented the staff report and reviewed the

Mr. Michels summarized the proposal meets all the applicable General Plan
Policies, and staff recommended approval with no additional conditions.
MOTION: A motion was made by Scott Leska, Member and seconded by Mary
Caswell, Member to approve OV13-07-10, architecture for a technology and
research center, with no additional conditions.

5. OV12-05-26, Stone Canyon LLC., represented by The WLB Group Inc.,

requests approval of a preliminary plat known as "Stone Canyon VIII, Lots

486-602", located within annexed area known as Rancho Vistoso
Neighborhood 12. Pima County approved a rezoning of CR-1 and CR-5 for

the area known as Rancho Vistoso Neighborhood 12, setting the stage for
the development of the Rancho Vistoso Neighborhood 12 and the creation
p
of the Honey Bee Biological Corridor from the proposed Tortolita Mountain
Park to Catalina State Park. Neighborhood 12 was annexed in March of
2002 and the zoningwas translated into Oro Valley zoning R1-36 and R-6.

Paul Olund, WLB Group, Non-resident reviewed the following:

Mr. Olund stated any disturbance within a rock cropping would require a minor
trade in accordance with the encroachment guidelines.

Paul Keesler, OV Development Review Manager, reviewed the hydrology of the
region in response to constituents concerns regarding drainage and stated that
the OV Public Works Department is working on the issue.
Staff recommended approval with the conditions listed in Exhibit A.
The DRB did not receive the Preliminary Plat, instead the Landscape Plan
was provided. After a brief discussion with Lexa Mack, OV Civil Attorney, it is
decided that the information provided is sufficient for the DRB to make a decision
on the item.
Gloria Glenn, resident, entered into the record a letter referencing concern for the
water drainage. Ms. Glenn showed a series of pictures depicting damage to her
property from the recent rains and asked the DRB to establish a minimum
setback for the development. In addition, Ms. Glenn asked for a minimum
setback for lot 493.
Mrs. Pelletier noted that the OVZCR requires a minimum 40 foot setback.
Mr. Keesler agreed to address the issue and will work with the Applicant and
their engineers.
Paul Olund, WLB, stated that he would be happy to work with the neighbor.
Mr. Zinkin requested that staff earmark lot 493 so that the neighbor is given
notice. Mrs. Pelletier agreed to earmark lot 493.
MOTION: A motion was made by Mary Caswell, Member and seconded by Ray
Shelton, Member to approve OV12-05-26, request for approval for a preliminary
plat known as Stone Canyon VIII, as requested by Vistoso Partners LLC.,
represented by the WLB Group Inc, subject to the conditions in Exhibit "A".
Mr. Keesler stated that there are very specific code requirements of what needs
to be done and staff will work with the applicant to encourage they work with the
neighbors.
MOTION carried, 5-0.
6. OV12-06-25, Rick Kleiner, property owner, represented by Novak
Environmental, requests relief from two provisions of the Oracle Road
Scenic Corridor Overlay District (ORSCOD): Section 24.5 D 1 d and
Section 24.5 D 1 e for the property known as "Oracle Vista Center", located
at the northwest corner of Oracle Road and Linda Vista Boulevard. The
parcel Number is 224-31-0110; the request is for relief from the ORSCOD
