(R) 01- 04 A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF ORO VALLEY, ARIZONA, AUTHORIZING THE FILING OF A CONDEMNATION ACTION TO OBTAIN COUNTRYSIDE (HOA) COMMUNITY CLUB, INC. PROPERTY FOR THE PURPOSE OF CREATING A WATER STORAGE FACILITY. WHEREAS, Oro Valley has the requisite statutory authority to acquire, own, operate and maintain a water utility for the benefit of the landowners within its boundaries pursuant to A.R.S. § 9-501 et seq.; and WHEREAS, Oro Valley is a political subdivision of the State of Arizona, is vested with all the rights, privileges and benefits and entitled to the immunities and exemptions granted to municipalities and political subdivisions under the Laws of the State of Arizona; and WHEREAS, the property in question, located within the Countryside Homeowners Association, formally known as Countryside Community Club, Inc., as depicted in Exhibit 1, attached hereto, is the optimum location for a water storage facility; and WHEREAS, it is necessary that Oro Valley condemn the land depicted in Exhibit 1, for the purpose of creating a water storage facility; and WHEREAS, the Town Council has deemed it necessary, in the interest of providing for the health, safety and welfare of the residents of the Town of Oro Valley, to authorize the Town Attorney to proceed with the condemnation proceedings against the property depicted in Exhibit 1, in order to ensure that the residents of Oro Valley will have a reliable water supply. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Town Council of the town of Oro Valley, Arizona, that the Town Attorney is authorized to proceed with the filing of a condemnation action to obtain the property depicted in Exhibit 1, attached hereto and incorporated herein by this reference. For the muttial promises contained herein and valuable consideration given, the Owner and the Town agree as follows: 1. On or before the date of closing, Owner shall pay all taxes and assessment which are a lien on the Property as of the date of closing. 7. This Settlement Agreement shall serve as escrow instructions to the Escrow Agent. 8. Upon Closing, a Stipulation for Dismissal of the Litigation shall be filed by the Town and the Owner. 9. Owner releases and forever discharges the Town of and from all manner of action, causes of action, claims, contracts, or demands whatsoever in law or in equity which the Owner may now have related to the Litigation. The Town hereby releases and forever discharges the Owner of and from all manner of action, causes of action, claims, contracts, or demands whatsoever in law or in equity which the Town may now have against the Owner related to the Litigation. 10. The Town and the Owner expressly agree that the terms.and and provision of this Settlement Agreement shall be deemed confidential. The Town and Owner and their attorney agree not to release any information concerning the Settlement Agreement to the general public including but not limited to attorneys and the media, including any press releases or other statements to the media. 11. (R) 04- 36 A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF ORO VALLEY, ARIZONA, AUTHORIZING THE TOWN ATTORNEY TO FILE A CONDEMNATION ACTION TO OBTAIN A PORTION OF THE HOPSON PROPERTY FOR THE PURPOSE OF RIGHT-OF-WAY FOR ROADWAY EXTENSION OF LA CANADA DRIVE; AND DECLARING AN EMERGENCY TO EXIST WHEREAS, Oro Valley has the requisite statutory authority to acquire, own, operate and maintain roadways for the benefit of the residents of the Town of Oro Valley; and WHEREAS, Oro Valleyis a municipal corporation within the State of Arizona, is vested with p � all the rights, privileges and benefits and entitled to the immunities and exemptions granted to municipalities and political subdivisions under the Laws of the State of Arizona; and WHEREAS, the property in question, located within Pima County, Arizona as depicted in Attachment 1, attached hereto, is necessary for the extension of La Canada Drive; and WHEREAS, it is necessary that Oro Valley condemn the land depicted in Attachment 1, for the purpose of the extension of La Canada Drive; and WHEREAS, the Town Council has deemed it necessary, in the interest of the residents of the Town of Oro Valley, to authorize the Town Attorney to proceed with the condemnation proceedings against the property depicted in Attachment 1, in order to ensure that the Town begin construction of the extension of La Canada Drive. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Town Council of the Town of Oro Valley, Arizona, that the Town Attorney is hereby authorized to proceed with the filing of a condemnation action to obtain the property depicted in Attachment 1, attached hereto and incorporated herein by this reference. BE IT FURTHER RESOLVED that it is necessary for the preservation of the health and safety of the Town of Oro Valley, Arizona that an emergency is declared to exist and this Resolution shall become immediately operative and in force from and after the date of adoption hereof.
