(R) 94 - 13 A RESOLUTION OF.THE MAYOR AND COUNCIL OF THE TOWN OF ORO VALLEY, PIMA COUNTY, ARIZONA, AUTHORIZING CONDEMNATION PROCEEDINGS TO ACQUIRE RANCHO VISTOSO WATER COMPANY The Mayor and Council of the Town of Oro Valley, Arizona, find as follows: 1. The Town of Oro Valley is authorized by A.R.S. § 9-511 et seq. to own and operate a water utility. 2. Acquisition of privately owned water companies rendering water service within or without the corporate limits of the Town of Oro Valley was authorized by the affirmative vote of a majority of the qualified electors of the Town of Oro Valley voting at a special municipal election duly called and held on March 9, 1993, for the purpose of voting upon the question, in accordance with A.R.S. § 9-514. 3. Acquisition by the Town of Oro Valley of the facilities, plant, system, and business used and useful in rendering the water distribution and delivery service currently rendered by the Rancho Vistoso Water Company is in the best interests of the citizens of the Town of Oro Valley. 4. Condemnation proceedings to acquire the facilities, plant, system, and business used and useful in rendering the water distribution and delivery service currently rendered by the Rancho Vistoso Water Company have been begun by the RECEI'VE,; Metropolitan Domestic Water Improvement District, which has by resolution indicated its consent for the Town of Oro Valley to be substituted as the FEB 2 5 condemning entity in place of Metropolitan Domestic Water Improvement District in those condemnation proceedings. of YALI NOW, THEREFORE, it is hereby resolved by the Mayor and Council of the Town of Oro Valley, Arizona, as follows: SECTION 1. The Town Attorney and special counsel to the Town are hereby authorized and directed to institute condemnation proceedings necessary for the Town of Oro Valley to acquire the facilities, plant, system, and business used and useful in rendering the water distribution and delivery service currently rendered by the Rancho Vistoso Water Company. SECTION 2. Institution of such condemnation proceedings may include the substitution of the Town of Oro Valley as plaintiff in place of Metropolitan Domestic Water Improvement District in the condemnation proceedings entitled Metropolitan Domestic Water Improvement District v.Rancho i tstoso grate, i oiripuriy, euineully pending ill the Pima County Superior Court, cause number 297077. 9 7 3 b i SECTION 3. All orders or resolutions in conflict with this Resolution are hereby repealed to the extend of such conflict, and this Resolution shall take effect immediately upon its adoption.
