Re: Countryside Community Club Inc., d/b/a Countryside Homeowners Association Final
Order of Condemnation
Bob Jacklitch evidently asked you if you had a copy of a deed on file with regard to the
transfer of property from Countryside Community Club, Inc., d/b/a Countryside Homeowners
Association to the Town as a result of our friendly condemnation with Countryside. It would
be extremely unusual for a deed to be issued in this context. Normally the only thing that's
issued is the final order of condemnation, which was entered on June 11, 2001 by the
Honorable Kenneth Lee. Although I advised water when the final order was entered I
evidently did not provide a copy of the final order to you for your records. Please find
attached a copy of the final order for your records.
If there is anything further, please advise.

A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN
OF ORO VALLEY, ARIZONA, AUTHORIZING THE FILING OF A
CONDEMNATION ACTION TO OBTAIN COUNTRYSIDE (HOA)
COMMUNITY CLUB, INC. PROPERTY FOR THE PURPOSE OF
CREATING A WATER STORAGE FACILITY.
WHEREAS, Oro Valley has the requisite statutory authority to acquire, own, operate
and maintain a water utility for the benefit of the landowners within its boundaries
pursuant to A.R.S. § 9-501 et seq.; and
WHEREAS, Oro Valley is a political subdivision of the State of Arizona, is vested
with all the rights, privileges and benefits and entitled to the immunities and exemptions
granted to municipalities and political subdivisions under the Laws of the State of
Arizona; and
WHEREAS, the property in question, located within the Countryside Homeowners
Association, formally known as Countryside Community Club, Inc., as depicted in
Exhibit 1, attached hereto, is the optimum location for a water storage facility; and
WHEREAS, it is necessary that Oro Valley condemn the land depicted in Exhibit 1,
for the purpose of creating a water storage facility; and
WHEREAS, the Town Council has deemed it necessary, in the interest ofrovidin

for the health, safety and welfare of the residents of the Town of Oro Valley, to
authorize the Town Attorney to proceed with the condemnation proceedings against the
property depicted in Exhibit 1, in order to ensure that the residents of Oro Valley will
have a reliable water supply.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Town Council of the
town of Oro Valley, Arizona, that the Town Attorneyis authorized to proceed with the lP'

A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN
OF ORO VALLEY, ARIZONA, AUTHORIZING THE FILING OF A
CONDEMNATION ACTION TO OBTAIN COUNTRYSIDE (HOA)
COMIVIUNITY CLUB, INC. PROPERTY FOR THE PURPOSE OF
CREATING A WATER STORAGE FACILITY.
WHEREAS, Oro Valley has the requisite statutory authority to acquire, own, operate
and maintain a water utility for the benefit of the landowners within its boundaries
pursuant to A.R.S. § 9-501 et seq.; and
WHEREAS, Oro Valley is a political subdivision of the State of Arizona, is vested
with all the rights, privileges and benefits and entitled to the immunities and exemptions
granted to municipalities and political subdivisions under the Laws of the State of
Arizona; and
WHEREAS, the property in question, located within the Countryside Homeowners
Association, formally known as Countryside Community Club, Inc., as depicted in
Exhibit 1, attached hereto, is the optimum location for a water storage facility; and
WHEREAS, it is necessary that Oro Valley condemn the land depicted in Exhibit 1,
for the purpose of creating a water storage facility; and
WHEREAS, the Town Council has deemed it necessary, in the interest of providing
for the health, safety and welfare of the residents of the Town of Oro Valley, to
authorize the Town Attorney to proceed with the condemnation proceedings against the
property depicted in Exhibit 1, in order to ensure that the residents of Oro Valley will
have a reliable water supply.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Town Council of the
town of Oro Valley, Arizona, that the Town Attorney is authorized to proceed with the
filing of a condemnation action to obtain the property depicted in Exhibit 1, attached
hereto and incorporated herein by this reference.
