RESOLUTION NO. (R) 07- 69 A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF ORO VALLEY, ARIZONA, AUTHORIZING AND APPROVING THE PROPERTY TRANSFER AGREEMENT BETWEEN FRI ROCK RIDGE, LLC AND THE TOWN OF ORO VALLEY, TRANSFERRING TO THE TOWN THE PROPERTY KNOWN AS THE "ROONEY WASH PROPERTY" WHEREAS, the Town of Oro Valley is a political subdivision of the State of Arizona vested with all associated rights, privileges and benefits and is entitled to the immunities and exemptions granted municipalities and political subdivision under the Constitution and laws of p the State of Arizona and the United States; and WHEREAS, pursuant to A.R.S. 9-240, the Mayor and Council are authorized to accept land transfers; and WHEREAS, FRI Rock Ridge, LLC desires to transfer to the Town that certain undeveloped parcel of real property called the "Rooney Wash Property"; and WHEREAS, the Town of Oro Valley desires to accept that certain undeveloped parcel of real property called Rooney Wash Property from FRI Rock Ridge, LLC; and WHEREAS, the transfer of the Rooney Wash Property to the Town permits the Town to improve and utilize the Rooney Wash Property for publicly beneficial purposes only. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Oro Valley, Arizona to authorize and approve the Property Transfer Agreement, attached hereto, transferring the "Rooney Wash Property" from FRI Rock Ridge, LLC to the Town. BE IT FURTHER RESOLVED that the Mayor and any other administrative officials of the Town of Oro Valley are hereby authorized to take such steps as are necessary to execute and implement the terms of the Agreement.
