HomeMy WebLinkAboutMinutes - Historic Preservation Commission - 1/9/2006 MINUTES HISTORIC PRESERVATION COMMISSION JANUARY 9, 2006 ORO VALLEY COUNCIL CHAMBERS 11000 NORTH LA CANADA DRIVE CALL TO ORDER: 6:03 PM PRESENT: VICE CHAIR ROBERT BAUGHMAN COMMISSIONER NANCY MAGER COMMISSIONER JIM KRIEGH COMMISSIONER AL KUNISCH ALSO PRESENT: CONNY CULVER, TOWN COUNCIL LIAISON BRENT SINCLAIR, AICP, COMMUNITY DEVELOPMENT DIRECTOR MARGOT HURST, PARKS AND RECREATION ADVISORY BOARD LIAISON STUDENT LIAISON, EMILY GRAVES JENNIFER JONES, RECORDING SECRETARY ABSENT: CHAIR PAMELA SARPALIUS COMMISSIONER PAIGE CHRISTIANSEN COMMISSIONER SYBIL NEEDHAM CALL TO AUDIENCE Opened and closed with no comment. I. APPROVAL OF MINUTES OF DECEMBER 12, 2005 MEETING Commissioner Kriegh requested that an amendment to the minutes be made. Mr. Kriegh stated that it was not his intent to state that the National Forest Service hired a company to build a bunker off of Linda Vista, Mr. Kriegh stated that it should read that a company was allowed to build a bunker off of Linda Vista . MOTION: Commissioner Kriegh MOVED to approve the minutes with the amendment. Commissioner Kunisch SECONDED the motion. Motion carried (4-0). II. HISTORY READING BY JIM KRIEGH Commissioner Kriegh read from an article from the Oro Valley Voice, dated October 1974, "Council can't disincorporate: Brandon says it can to", Mr. Kriegh stated that at the time Schwanbeck was Town Attorney and the appointed Council consisted of Virgil Brandon, Dorothy Montgomery, Steve Engle, Kenneth Holford and himself. Mr. Kreigh stated that Mr. Holford had to vote for himself to become the first Mayo and explained that Mr. Holford was supposed to be neutral, but he really wasn't, he was on the anti-Town side of things. Commissioner Kriegh also read from an article from the Tucson Daily Citizen, dated October 23, 1974, "Oro's Kitchen Cabinet", which referred to when the Town quit holding meetings at CDO High School and moved into the two-bedroom apartment at 9040 N. Oracle road. III. REPORT FROM THE ORO VALLEY HISTORICAL SOCIETY Commissioner Kriegh informed the Commission that starting in February 2006 the Oro Valley Historical Society will be having their meetings at the Oro Valley Public Library. Commissioner Kriegh also reported that the Oro Valley Historical Society membership, including charter members is at 59. IV. REPORT FROM THE HISTORIC PRESERVATION ORDINANCE TASK FORCE; TO ACCEPT THE DRAFT ORDINANCE Vice Chair Baughman pointed out that they do have a quorum, but they are a bare majority. Mr. Baughman stated that there are two Commissioners missing that probably know the least about the ordinance draft of all the Commission members. Mr. Baughman stated that he intended on presenting some alternatives to the Commission, but is leaning toward one direction. Mr. Baughman informed the Commission that Commissioner Mager wants to raise something about the draft. Commissioner Mager stated that on page one under "Purpose", it talks about the Town of Oro Valley and lists all of the points and then there is "B" the Mission of the Historic Preservation Commission, which there is no mention in the previous paragraph of the Historic Preservation Commission and she feels that it is disjointed. Ms. Mager suggested that the end of the first paragraph be revised to reflect an introduction to the Historic Preservation Commission. Vice Chair Baughman asked Ms. Mager,.if at the end of the last phrase of the first paragraph under "Purpose" before the points are listed, if it read "and the establishment of a Historic Preservation Commission at the direction of the Oro Valley Town Council", if her concern would be answered. Commissioner Mager stated that sounded good to her. Vice Chair Baughman pointed out that the provisions for liaisons was omitted from the draft ordinance. Mr. Baughman suggested that on page 5 under"Powers and Duties of the Commission", moving the current letter"W"to "X", and adding a new"W"to read: "Establish liaison with groups and organizations as appropriate". Vice Chair Baughman stated that they are faced now with the basic decision of what to do with this draft ordinance. Mr. Baughman stated that they have the authority under law to adopt this draft ordinance, but alternatively they can defer action until the next meeting, where more members of the Commission will be present to consider it. Commissioner Kriegh pointed out that everybody received the draft ordinance some time ago and if any Commission members who are not present, had any comments they would have sent those comments to either Mr. Baughman or Mr. Sinclair. Mr. Kriegh also stated that he does not know if it is necessary to hold off and he agrees with the amendments that were made at this meeting. Vice Chair Baughman asked Commissioner Mager what her thoughts were on delaying this item. Commissioner Mager stated that they should move on and agrees with Commissioner Kriegh that everyone has had plenty of time and the draft ordinance has been sent to the Commissioners with numerous iterations and doesn't see why they shouldn't go ahead. JANUARY 9, 2006 DRAFT MINUTES, HISTORIC PRESERVATION COMMISSION Commissioner Kunisch stated that he agrees they should move on with it, a lot of time has been put into it and the other Commissioners have been involved in the process and if they did have any comments, they would have gotten back to someone with them. MOTION: Commissioner Kunisch MOVED to adopt the Historic Preservation Draft Ordinance with the amended changes and recommend adoption by the Town Council. Commissioner Mager SECONDED the motion. Motion carried (4-0). Discussion: Commissioner Mager stated that it needs to be noted that this a draft and if there are other changes or suggestions it is going to Town Council, where there is another opportunity for somebody who has really pointed suggestions. Commissioner Mager stated that it is critical to get the ordinance to Town Council, and feels it would be great to get it out there publicly so that people can see what the Commission has been doing for the last few of months. Vice Chair Baughman expressed his appreciation to the following people: Commissioner Kriegh and Commissioner Kunisch for their time that they put into working on the Historic Preservation Commission ordinance, Mr. Baughman stated that they know the Town and its intricacies and have been incredibly helpful in'the process. •Brent Sinclair, Community Development Director, for his assistance and showing up in,meetings when necessary and leading them through labyrinths. Melinda Garrahan, Town Attorney and Joe Andrews, Chief Civil Deputy, who have been thorough in reviewing the ordinance and filing in any holes they found. Jennifer Jones for her assistance. V. REPORT FROM STUDENT LIAISON Ms. Graves stated that she did not have anything specific to report, but she has been working on her leadership skills with the Tucson Women's Leadership program. VI. REPORT FROM THE PARKS AND RECREATION ADVISORY BOARD No report for this meeting. VII. REPORT FROM THE SANTA CRUZ NATIONAL HERITAGE AREA ALLIANCE LIAISON Commissioner Mager reported that the Santa Cruz National Heritage Area Alliance met on the evening on December 16, 2005, however it was not a formal meeting. Ms. Mager stated she was supposed to be officially voted in to the Santa Cruz National Heritage Area Alliance on that evening, but due to people coming and going they were unable to get a quorum to do that. Ms. Mager stated that some of things discussed were having Congressman Kolbe bring this into Congress in January to get the ball rolling. Ms. Mager stated that the Alliance wants to do some type of kick off party in Tucson, sometime this month and they want to get Mr. Kolbe and some other JANUARY 9, 2006 DRAFT MINUTES, HISTORIC PRESERVATION COMMISSION dignitaries to attend this party. Ms. Mager also stated that there was mention of making this a legacy bill for Congressman Kolbe and to putting some regional support around it. Ms. Mager stated that she does not know the status of the party and stated that there were several people that were going to contact Congressman Kolbe and try to pin him down for dates, then the event would start to come together based on that, but she has not heard anything about it. Ms. Mager stated that she hopes that she will have more to report next month and if this event does come around, she is hoping to invite everyone. Vice Chair Baughman stated that he liked the idea of making it a memorial to Congressman Kolbe. Mr. Baughman informed the Commission that Congressman Kolbe is going to chair an appropriation sub-committee for all of this year. VIII.
